Terms of Service

1. Acceptance of Terms

By accessing or using Tomte (the "Service"), operated by Heytomte ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are using the Service on behalf of a household, you represent that all household members using the Service have agreed to these Terms.

2. Description of Service

Tomte is a family coordination application available at heytomte.com. The Service helps households coordinate calendars, tasks, chores, grocery lists, and meal planning across family members. Features include AI-assisted quick-add, Google Calendar sync, iCal feed export, and push notifications.

3. Accounts and Households

To use the Service you must create an account with a valid email address and password, or sign in with Google. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

The Service is organized around households. One member of each household holds the "Owner" role and is responsible for managing household membership, including inviting and removing members. You must not share your account credentials with others; instead, use the household invite feature to add additional members.

You must be at least 13 years old to create an account. Household owners may add child profiles on behalf of minors — children do not create their own accounts.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated means to access the Service without our prior written consent.
  • Upload or transmit any content that is harmful, offensive, or infringes the rights of others.

5. Your Content

You retain ownership of the data you enter into the Service (calendar events, tasks, chores, lists, recipes, and other household information). By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you and your household.

You are responsible for ensuring that any content you add to the Service is accurate and that you have the right to add it. We do not claim ownership of your content and will not use it for purposes beyond operating and improving the Service.

6. AI Features

The AI quick-add feature (the ⚡ button) sends your input to Anthropic, PBC for classification and parsing. By using this feature, you consent to your input being transmitted to Anthropic for this purpose. AI-generated suggestions are provided as a convenience and may not always be accurate; you are responsible for reviewing and confirming any content added via AI quick-add.

7. Third-Party Integrations

The Service offers integrations with third-party services, including Google Calendar. Your use of those integrations is also subject to the respective third party's terms of service and privacy policy. We are not responsible for the acts or omissions of third-party services.

8. Privacy

Our Privacy Policy describes how we collect, use, and share your information. By using the Service, you agree to the collection and use of your information as described in the Privacy Policy.

9. Intellectual Property

The Service, including its design, software, and content (excluding your household data), is owned by Heytomte and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We are not responsible for the accuracy of AI-generated content, the availability of third-party integrations, or the loss of data resulting from events outside our reasonable control.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEYTOMTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify and hold harmless Heytomte and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may stop using the Service at any time. To delete your account and associated data, contact support@heytomte.com.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. Upon termination, your right to use the Service immediately ceases.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration in San Francisco, California under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. YOU AND HEYTOMTE WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and notify active users by email or in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
